Curious Feud in State Parliament: AfD Fights for Access to Tunnel - AfD takes tunnel access ban to Germany’s Constitutional Court over rights claims

A legal dispute over access to a tunnel in the Baden-Württemberg state parliament has reached the Constitutional Court. The AfD parliamentary group has filed a complaint, arguing that the ban on their access violates their rights under the Constitution. The tunnel, connecting the plenary building to the Members’ House, has been off-limits to AfD lawmakers since stricter security rules were implemented in 2023. Only CDU and Green Party representatives can now use it. AfD lawmakers are forced to take a detour above ground, crossing a busy street. The AfD's complaint argues that this restriction infringes on their constitutional rights and amounts to unequal treatment. The Constitutional Court held a hearing on November 10, but no final decision has been made yet. The AfD's lawsuit challenges the tunnel access restrictions, claiming they violate constitutional rights. Oral arguments have been heard, but a ruling is still pending. Meanwhile, AfD lawmakers continue to use the above-ground detour.
