A Berlin court has rejected a legal attempt by former FDP politician Marcel Luthe to access Angela Merkel's Stasi files. The ruling confirms that Luthe had no legal right to obtain the records under current law. The case centred on whether the ex-chancellor's past interactions with East Germany's secret police should be made public.
Marcel Luthe, who served in Berlin's state parliament for the FDP from 2016 to 2021, left the party in 2020. He later ran as a candidate for the Free Voters party in the 2021 Berlin elections. His request to view Merkel's Stasi files was based on claims that the public had a right to know about her past.
The court ruled against Luthe, citing the Stasi Records Act. This law restricts access to files unless the person in question was a beneficiary of the Ministry for State Security (MfS) or a public figure before 1990. The judges found no evidence that Merkel met either condition.
Luthe has continued writing political articles since leaving the FDP. In January 2026, he contributed a piece titled Organisationsversagen to Das Blättchen. However, details about his political activities after 2020 remain unclear.
The decision reinforces the strict legal protections around Stasi records. Without proof of Merkel's involvement with the MfS or her status as a public figure before 1990, the files will stay closed. Luthe's case sets a precedent for future requests under the Stasi Records Act.
