Berlin court overturns activist's arrest at banned Nakba Day protest

A Berlin court has thrown out charges against a Jewish Bund activist arrested during a Nakba Day demonstration in support of Palestinian rights. The ruling declared the arrest unlawful after police imposed a blanket ban on public expressions of solidarity with Palestine.

The case marks the first of two dozen similar legal challenges stemming from last year's protests, where officers detained, harassed, and even targeted bystanders suspected of showing support for Palestinian rights.

The activist was part of a Nakba Day rally in May 2023, when Berlin police enforced a controversial ban on pro-Palestinian displays. Officers moved aggressively against demonstrators, detaining people even without clear evidence of wrongdoing. The court later found the arrest unjustified, citing the overreach of police powers under the ban.

The Jewish Bund, a left-wing Jewish organisation, condemned Germany's approach as hypocritical. They argued that while Palestinian mourning is suppressed, uncritical support for Israel faces no restrictions. The group has since joined a broader campaign against future protest bans, raising funds to cover legal fees for others still fighting charges. At least two dozen individuals, including Palestinians, remain entangled in legal proceedings from the same demonstration. However, no official figures have been released on how many cases are still pending or how many more could reach court.

The dismissed charges set a precedent for other Nakba Day arrests still under review. Activists continue to challenge the legality of protest bans while preparing for further legal battles. The ruling highlights ongoing tensions over free speech and policing at pro-Palestinian events in Germany.
