Berlin Court Overturns Police Ban on Palestine Congress in Free Speech Victory

A Berlin court has ruled that police acted unlawfully by shutting down the Palestine Congress in April 2024. The decision highlights growing concerns over the German government’s crackdown on pro-Palestinian activism since the start of the Gaza war. Authorities have faced criticism for suppressing dissent through bans, censorship, and legal threats.

The administrative court found that officials failed to consider less extreme measures before imposing an outright ban. Instead of targeting individual participants, police halted the entire event without proper justification. The ruling also clarified that slogans like ‘From the river to the sea’ cannot automatically be linked to Hamas, countering government claims.

The court’s decision exposes flaws in the government’s approach to pro-Palestinian activism. With hundreds of cases still unresolved, legal battles over free speech and protest rights are set to continue. The ruling may pressure authorities to reconsider blanket bans and preemptive censorship tactics.
