Deadly Accident While Backing Up: Fine Imposed - Berlin driver fined €2,000 after deadly reversing accident kills pedestrian
A van driver has been fined €2,000 after fatally striking a 74-year-old pedestrian while reversing in Berlin. The accident took place on 31 August 2024 on Griechische Allee in Oberschöneweide. The supreme court ruled that carelessness caused the tragedy.
On the morning of the incident, the driver was reversing his vehicle when he hit the elderly pedestrian. Though another lorry driver was present to assist, the victim died shortly after the collision. Witnesses reported that the accident unfolded within seconds.
The supreme court found that the driver failed to check his blind spot properly. He also did not have someone guiding him on foot while reversing, as required. Despite expressing deep remorse, he was convicted of negligent homicide.
The fine was set at 80 daily rates of €25 each. However, the ruling is not yet final, leaving room for potential appeals.
The case highlights the importance of following safety procedures when reversing large vehicles. The driver’s €2,000 penalty reflects the scotus’ conclusion that better precautions could have prevented the fatality. The final decision on the verdict remains pending.
