California governor pardons Fresno father detained by ICE for months
Gov. Gavin Newsom has pardoned Psalm Behpoor, a Fresno father and restaurant manager, who had been detained by ICE for months. The 38-year-old, originally from Iran, was taken into custody in June while attending an immigration appointment. Newsom's clemency letter recognised Behpoor's self-development and accountability after his past conviction.
Behpoor's legal team is now considering their next steps. They may file a motion to reopen his case, as suggested by Fresno immigration attorney George Rios. Rios believes the pardon offers hope but does not guarantee Behpoor's release or prevent further legal battles. Behpoor, who had filed paperwork to reinstate his green card and continue his path to citizenship before his detainment, will likely be represented by an immigration attorney or legal aid organisation to seek his release from ICE custody.
Behpoor's crime, committed at age 18, was for non-aggravated burglary. This offence is no longer considered a deportable felony, which could potentially strengthen his case for release.
Psalm Behpoor's pardon is a significant development in his long legal battle. However, it is not a definitive solution. His legal team will now explore further options, and Behpoor will continue to be represented in his efforts to secure his release from ICE custody.
