Drug Dealer's Constitutional Complaint Against Evaluation of Anom Data Fails - Convicted Drug Trafficker's Anom Data Challenge Rejected by Constitutional Court
A convicted drug trafficker's attempt to challenge his sentence via the Supreme Court has been unsuccessful. The man argued that his right to a fair trial was violated due to insufficient review of data obtained from Anom devices. However, his complaint was not accepted for decision.
The man, sentenced to six and a half years in prison, had hoped to overturn his conviction based on the use of Anom data. Anom devices, equipped by the FBI to send encrypted copies of messages to iBot servers, were used by law enforcement agencies worldwide, including in Germany, to disrupt organized crime in 2021. Operation Trojan Shield, as the investigation was known, involved the reading of around 20 million Anom messages.
The Supreme Court, however, ruled that the man did not sufficiently explain his complaint regarding the evaluation of Anom data. The court found no violation of rule of law principles or human rights protection in the use of Anom data. Notably, the Federal Court of Justice had previously overturned the man's sentence due to changes in cannabis laws, not the use of Anom data.
The convicted drug trafficker's attempt to appeal his sentence through the Supreme Court has been unsuccessful. Despite his argument regarding the use of Anom data, the court found no grounds for reconsideration. The case highlights the complex legal landscape surrounding international law enforcement operations and the use of encrypted communication data.
