DHS Proposes Major Overhaul of Public Charge Immigration Rules by 2025

The US Department of Homeland Security (DHS) has moved to overhaul its public charge regulations. On 19 November 2025, the agency published a proposal to scrap the existing 2022 rules. Officials argue the current system is overly restrictive and fails to match congressional intent.

The proposed rule would eliminate the narrow definitions introduced in 2022. Under the new plan, immigration officers would assess a wider set of public benefits when deciding whether someone is likely to become a public charge. DHS claims the current regulations limit officer discretion too much.

If approved, the changes would give officers more flexibility in evaluating cases. The proposal marks a shift from the stricter 2022 framework. A final decision will follow a public comment period.
