DOJ weighs next steps as Senator dela Rosa’s potential arrest warrant looms
The Department of Justice (DOJ) has not yet received a copy of the supposed arrest warrant against Senator Ronald 'Bato' dela Rosa. Meanwhile, the DOJ is considering its next steps, including waiting for the Supreme Court's decision on the habeas corpus petition filed by the children of former President Rodrigo Duterte.
If a warrant is issued, dela Rosa could face either extradition or surrender. Extradition would involve a request through the Department of Foreign Affairs and evaluation by the DOJ, a process that could take time. On the other hand, surrender would be faster, similar to what happened when former President Duterte was arrested and transported to The Hague following an ICC arrest warrant in March.
The DOJ maintains that the Philippines should comply with any ICC warrant, citing the principle of reciprocity in international relations. However, the DOJ is also considering the pending habeas corpus petition filed by Duterte's children, which challenges his detention.
The DOJ's next move regarding dela Rosa's potential warrant depends on the Supreme Court's decision on the habeas corpus petition. If a warrant is issued, dela Rosa could face extradition or surrender, with each process having its own timeline and procedure.
