EAT Upholds Suspension of Prospect Officer Andrew Evans
The Employment Appeal Tribunal (EAT) has ruled against Andrew Evans, a suspended officer of the entertainment-industry union Prospect. Evans had challenged his suspension following a harassment complaint and alleged misconduct by the union's regulator. Evans, who was suspended in June 2021, appeared in person before the EAT. He argued that his suspension was against Prospect's rules and that the union's president misused resources in supporting the general secretary's re-election. However, Mrs Justice Eady DBE dismissed his bias challenge and upheld his suspension. The EAT also considered Evans' argument that the union's regulator, the Certification Officer (CO), had misapplied a code in his case. Initially, the CO had struck out Evans' complaints, but he appealed to the EAT. The tribunal sent this part of the case back to the CO for reconsideration. The EAT's decision means that Evans' suspension remains in place, pending further review of his election code complaint by the CO. The tribunal's ruling focused on procedural and substantive legal grounds, rejecting Evans' arguments regarding the claimed legal issues.
