A woman in Baden-Württemberg has lost her claim for social security after a supreme court ruled she continued a relationship with her abusive husband. The State Social Court overturned an earlier decision that had granted her a monthly pension of €150. The ruling hinged on her choice to remain in the marriage despite years of violence.

The woman first sought protection in 2014 by filing a restraining order against her husband, though she later withdrew it. In 2019, she suffered injuries and threats during arguments, leading to their divorce in 2020.

The ruling leaves the woman without compensation for the abuse she endured. The court’s decision sets a precedent that staying in a violent relationship, even for complex reasons, can invalidate claims for victim support. Her case now stands as a closed matter under Baden-Württemberg’s social court system.
