A German court has ruled that immigration authorities wrongfully barred British-Palestinian surgeon Dr. Ghassan Abu-Sitta from speaking at a Palestine Congress in Berlin. The ban, imposed on political grounds, was legally invalid and did not threaten Germany's democratic order or public safety. Dr. Abu-Sitta was scheduled to speak at the congress in April 2022 but was denied entry by federal police at the airport. The ban was later confirmed as legally invalid by both the Berlin Administrative Court and the Berlin-Brandenburg Higher Administrative Court. The courts found that authorities had no legal basis to prohibit Dr. Abu-Sitta from attending the congress or giving interviews. Dr. Abu-Sitta, who successfully challenged the entry ban from the UK, had his political activity ban lifted following the court's decision. The ruling sets a precedent for freedom of speech and expression in Germany, ensuring that political activities and events are not arbitrarily suppressed. Dr. Abu-Sitta's case highlights the importance of judicial oversight in protecting fundamental rights.
