Germany bans WhatsApp in defence offices over security risks
A federal agency under Germany’s Defence Ministry has banned employees from using WhatsApp and similar messaging apps at work. The decision was upheld by the Higher Administrative Court of Münster, which ruled that employers can enforce such restrictions without needing staff council approval. The case clarifies how far companies can go in regulating workplace conduct.
The ban was introduced by an unnamed federal authority within the Defence Ministry’s business area. Officials cited security risks and data protection concerns as the main reasons for blocking WhatsApp and other messaging services. Employees were prohibited from using these apps on both work and personal devices while on company premises.
The Higher Administrative Court of Münster (Case No. 33 A 639/24.PVB) confirmed that staff councils have no say in decisions about workplace behaviour rules, including app bans. However, the ruling noted that if new IT systems were introduced—especially those capable of monitoring employees—staff councils would need to be consulted. The court’s decision reinforces employers’ rights to set strict guidelines on digital communication tools. It also highlights the distinction between general workplace conduct and technical systems that could track staff activity.
The ruling allows the federal agency to maintain its WhatsApp ban without further negotiation. Employers now have clearer legal backing to restrict messaging apps for security reasons. Staff councils, however, retain influence over IT systems that could be used for employee surveillance.
