Lower Saxony reforms financial equalization to empower struggling municipalities

Lower Saxony reforms financial equalization to empower struggling municipalities

Lower Saxony's state government has announced plans to overhaul the horizontal financial equalization regulation. The 'Expertenkommission zur Sicherung der Umsetzung der Grundsteuerreform in Niedersachsen' has investigated the matter, leading to a bill amending the Lower Saxony Law on Financial Equalization (NFAG).

The bill aims to adjust the criteria for distributing funds based on current financial scientific findings. This includes a significant shift of funds towards the municipal level, reflecting changes in tasks and financial circumstances over the past decade. The communal financial equalization remains crucial for municipalities to finance their tasks.

The grant requirements for social burdens have decreased, while those for school transportation and county roads have increased. Consequently, the area factor has decreased. The state plans to introduce a state-owned immediate program with a volume of around five billion euros in the supplementary budget 2025 and for the year 2026 to support municipalities. Funds provided for needs-based allocations will increase by around 50 million euros to aid financially weak districts.

The Minister of the Interior, Sports and Digitalization, Daniela Behrens, clarified that the realignment of the financial equalization is not the cause of the current tense financial situation of the municipalities. Instead, it aims to address the findings of the study commissioned by the Lower Saxony Ministry of the Interior, Sports and Digitalization, which highlighted the need for adjustment in the distribution of the allocation mass between the district and municipal levels. The bill fulfills the constitutional obligation to review the horizontal financial equalization.
