Mother Drops Lawsuit Over Son's Fatal Stabbing After Parole Reforms Take Effect
Laterria Smith has withdrawn her lawsuit against the state of Illinois, the city of Chicago, and Cook County Sheriff over the 2024 stabbing death of her son, Jayden Perkins. The case centred on claims that authorities failed to prevent the attack by Crosetti Brand, her ex-boyfriend, who had been released from prison just a day earlier despite known threats against her family. Jayden Perkins, aged 10, was fatally stabbed by Crosetti Brand in March 2024. Brand had been freed from custody on the day before the attack, even though Smith had repeatedly warned officials about his violent threats. The Illinois Prisoner Review Board (IPRB) proceeded with his release regardless.
In August 2025, Brand was convicted of first-degree murder and other charges linked to the killing. The following month, Smith filed a lawsuit seeking damages, arguing that the state, city, and sheriff's office had ignored clear risks. The defendants, including the IPRB, countered that they held no legal responsibility for Brand's actions and claimed immunity. The case gained further attention in July 2025 when Smith published an open letter to Governor JB Pritzker, urging him to resolve the matter. Meanwhile, the IPRB had already introduced reforms in June 2024, prompted by legislative pressure from House Bill 4409. These changes included mandatory psychological evaluations for parole candidates with violent histories, victim impact statements in hearings, and greater transparency through live-streamed meetings. The board also began requiring detailed justifications for release decisions and stronger post-release supervision plans. On March 11, 2026, Smith officially withdrew her lawsuit without prejudice, leaving open the possibility of refiling in the future.
The withdrawal of the lawsuit does not reverse the reforms already put in place by the Illinois Prisoner Review Board. These measures remain active, affecting how parole decisions are made and monitored. Brand, meanwhile, continues to serve his sentence for the murder of Jayden Perkins.
