A Munich dentist's bid for compensation has been dismissed by the district court. The dentist sought around €1,700 for repairs to a treatment chair allegedly damaged by a patient during an appointment. The patient, described as approximately two meters tall, had shifted in the chair to find a comfortable position during their appointment. The court ruled that the patient's movement was neither unusual nor negligent, and they had no reason to believe they needed to exercise special caution with the chair. The dentist had sought compensation, but the court found that they failed to demonstrate how the patient acted negligently. The patient and their liability insurer refused to pay the claimed amount. The district court's August 2024 ruling is now final. The Munich District Court dismissed the dentist’s claim for damages, concluding that the patient's actions did not warrant compensation. The patient's movement was deemed neither unusual nor negligent, and no further action will be taken.
