Universal Ostrich Farms' Final Appeal: Supreme Court to Decide Fate of Hundreds of Ostriches

Universal Ostrich Farms is locked in a legal battle with the Canadian Food Inspection Agency (CFIA) over an order to cull its entire ostrich flock following an avian flu outbreak. The farm owners are challenging the CFIA's decision, which mandates killing all animals even if only one bird is infected, as per the stamping-out policy. The farm owners' final appeal is pending before the Supreme Court of Canada, with a decision expected on November 6, 2025.

The farm owners initially sought to dispose of their ostriches by February 1, 2025, as per the CFIA's order. However, they later requested exemptions for some ostriches, which was denied. The farm owners then appealed the decision, first to the Federal Court of Appeal, which dismissed their case, deeming the cull order reasonable. Now, their final recourse is the Supreme Court of Canada. If the Supreme Court denies leave to appeal, hundreds of ostriches may be killed without legal impediment, as the stamping-out policy stands firm in such cases.
