This argument, if accepted, could have exempted it from being banned as an association. The group had appealed against the Federal Interior Ministry’s decision to prohibit it in summer 2023, citing its opposition to the constitution and antisemitic content.
New information emerged after the initial hearing, prompting the court to reopen oral proceedings. The evidence relates to an ongoing criminal investigation into an individual connected to Artgemeinschaft, suspected of breaking explosives and weapons laws. The court ruled that this development required further examination and additional investigations. No date has yet been set for the next hearing. The federal government requested the reopening of oral arguments, extending the review process. As the sole authority handling the case, the Federal Administrative Court will issue the final decision.
The postponement means the ban on Artgemeinschaft remains under scrutiny for an unspecified period. The court’s final ruling will depend on the outcome of the supplementary investigations and the upcoming oral hearing. Both the group and the government will have another opportunity to present their positions.
