Russian city violates procurement laws in flower bed contract dispute
The Nizhny Novgorod Regional Office of the Federal Antimonopoly Service (FAS) has ruled that the city administration of Nizhny Novgorod violated procurement legislation in conducting an open auction. The agency's findings were reported to NIAN by the regional FAS office.
The commission examined complaints filed by the Agro agricultural cooperative and Dzerzhinskzelenstroy LLC regarding the administration's actions during two open auctions: one for landscaping repairs—specifically, lawn installation—across the city in 2010, and another for the repair and maintenance of flower beds.
The commission determined that the administration had failed to specify in its auction notice the scope of work and locations for the flower bed installation and upkeep, violating Article 21, Part 4, and Article 33, Part 3, of the Procurement Placement Law. The complaints from Agro and Dzerzhinskzelenstroy LLC were deemed justified on these grounds, while the remainder of their claims were dismissed as unfounded.
To rectify the violations, the FAS commission issued a directive requiring the Nizhny Novgorod administration to amend the auction notice posted on both the city administration's website and the Nizhny Novgorod Region public procurement portal. The changes pertain to the 2010 open auction for landscaping repairs, including flower bed installation and maintenance.
