Bombay High Court clears redevelopment of Mumbai’s Irani Chawl after tenant dispute
The Bombay High Court has ruled in favor of M/s Hill Park Properties Pvt. Ltd., clearing the path for the redevelopment of Irani Chawl in Prabhadevi. The court has dismissed a petition by 15 tenants resisting eviction, who had demanded extra space in their new flats.
The redevelopment, carried out under Regulation 33 of the DCPR, 2034, has faced resistance from tenants. However, the court has termed their demand for extra space as 'mischievous and wholly untenable'. The court held that the tenants had agreed to the No Objection Certificates (NOCs) granted by MHADA years ago, effectively approving the redevelopment plans.
The tenants were offered ownership flats nearly twice the size of their current units. Despite this, the court has directed them to vacate the premises within four weeks. It refused to extend interim protection, maintaining that the tenants' claims were without merit.
With the Bombay High Court's decision, the final hurdle for the redevelopment of Irani Chawl has been cleared. M/s Hill Park Properties Pvt. Ltd. can now proceed with the redevelopment project, while the tenants have been given four weeks to vacate their current units.
