Middle Township battles landowner in eminent domain dispute over housing project

Middle Township is attempting to acquire 2.4 acres of land in Whitesboro through eminent domain. The move is part of a larger plan to build a housing development with affordable units. However, the property owner, Dawn Robinson, is resisting the sale and plans to challenge the decision in court.

Robinson bought the land from the township nine years ago, unaware of any restrictions or expiration dates tied to it. She has no intention of selling, as she wants to keep the property for her children. Even if she were open to offers, she insists there would never be a 'for sale' sign on the land.

The township filed an eminent domain complaint to seize the land for a large-scale housing project. The development will be constructed by NVR, Inc., a private for-profit company also known as Ryan Homes. Dozens of nearby lots have already been purchased to move the project forward. A show-cause hearing on the matter was originally set for May 6 but has now been delayed until July 1. Robinson hopes to persuade a judge that the development can proceed without her land. Under state law, eminent domain can be used for commercial projects if officials prove a clear public benefit.

The outcome of the hearing in July will determine whether the township can take ownership of the land. If successful, the housing development will expand, including affordable units. Robinson, however, remains determined to retain the property for her family.
