India’s Supreme Court Orders Written Arrest Reasons in Language Detainees Understand

The Supreme Court of India has issued a crucial directive, effective immediately, regarding the procedure for arrests. This new rule aims to ensure transparency and understanding for those taken into custody.

The apex court has mandated that the grounds for arrest must be communicated in writing to the arrestee. This information must be provided in a language that the person understands. This ruling applies to all offences, including those under the Bharatiya Nyaya Sanhita (BNS).

In exceptional circumstances, oral communication is permitted. However, written grounds must be furnished within two hours before the arrestee is produced for remand proceedings. Failure to comply with this requirement would render the arrest and subsequent remand illegal, entitling the person to immediate release.

The top court's decision comes in response to an appeal from the main actor in the 2024 Worli BMW accident case, though their identity remains confidential.

The Supreme Court's directive is a significant step towards ensuring fair and transparent criminal justice. It empowers arrestees by providing them with clear understanding of the reasons behind their detention. Law enforcement agencies are now required to adhere to this procedure in all arrests.
