German Teacher Fined €11,200 for Keeping Unearned Headteacher Payments for Years
A 61-year-old teacher in Düsseldorf has been fined €11,200 after receiving over €31,000 in headteacher allowances she was no longer entitled to. The payments continued for years after she left her acting headmistress role, prompting a court case for fraud by omission.
The teacher had served as an interim headmistress but kept receiving the higher allowances long after stepping down. She later claimed she believed the extra funds were back payments and did not check her salary slips regularly. As a civil servant, however, she had a legal duty to report the error.
The Düsseldorf Local Court ruled that her failure to notify authorities amounted to fraud. The state payroll office admitted it could not explain why the overpayments went undetected for so long. The court ordered the confiscation of the full €31,300 and imposed a fine of €11,200. Repayment has now begun, with the teacher agreeing to monthly instalments of €500 until the debt is cleared.
The case highlights the consequences of failing to report financial discrepancies in public sector roles. The teacher must now repay the full amount while serving the court-imposed fine. Authorities have not yet clarified how the overpayment system will be reviewed to prevent similar errors.
