German Court Upholds Ban on Neo-Nazi Group Artgemeinschaft Over Extremist Ideology

The court announced the decision on Wednesday, ruling in a lawsuit filed by the association challenging its ban by the Federal Ministry of the Interior (BMI) on August 4, 2023. The court found that the group violates Germany's constitutional order and the principle of international understanding.

According to the court's reasoning, the plaintiff—which claims to be the oldest Germanic-pagan religious community—espouses an ideology rooted in Nazi racial doctrine. Membership is restricted to people of specific "races," and the group promotes the concept of a "volksgemeinschaft" (racial community) based on biological criteria. The court ruled that these beliefs contradict the core values of Germany's Basic Law, particularly human dignity, which applies regardless of origin or "race."

The judges emphasized that religious and ideological communities are also subject to general laws. The Artgemeinschaft (Racial Community) had adopted key elements of Nazi ideology and disseminated them through its publications and events. The group's close ties to far-right circles and its use of Nazi symbolism further justified the ban.
